Shop operators must comply with certain legal requirements arising from the Data Protection Act.
Necessary measures for shop operators
The shop operator is obliged to inform its customers about the transfer of information for the processing of orders and payments to Creditreform and its processing in the context of the creditworthiness assessment. In addition, a reference to the declaration of consent to the credit and risk check for purchase on invoice must be integrated into the GTC. For the rest, the General Terms and Conditions of SVC shall apply and reference shall be made to the data protection declaration.
1. Explicit customer consent in online trading
Before a creditworthiness and risk check is carried out for a transaction in online commerce, the buyer must give his or her express consent. As a rule, the check is carried out before the payment method selection is displayed. For this purpose, a check box with the following declaration text must be set up, which must be activated by the buyer.
☐ I accept the GTC of the shop and acknowledge that the decision on the possibility of delivery against invoice is based on automated processing and I consent.

Declaration of consent to credit and risk assessment
In order to decide whether delivery can be made on invoice, an address and creditworthiness check is carried out. Personal data relevant to the processing of the order and payment may be transmitted to Schweizerischer Verband Creditreform Gen and also to partner companies for this purpose. The Creditreform Data Protection Declaration (DPD) applies in this regard.

Für den Entscheid, ob gegen Rechnung geliefert werden kann, wird eine Adress- und Kreditwürdigkeitsprüfung durchgeführt. Die für die Auftrags- und Zahlungsabwicklung relevanten personenbezogenen Informationen können dazu dem Schweizerischen Verband Creditreform Gen und auch an Partnerunternehmen übermittelt werden. Hierzu gilt die Datenschutzerklärung Creditreform (DSE).

Afin de décider si la livraison peut être effectuée sur facture, une vérification de l'adresse et de la solvabilité est effectuée. Les données personnelles pertinentes pour le traitement de la commande et du paiement peuvent être transmises à l'Union Suisse Creditreform SCoop ainsi qu'à des entreprises partenaires à cette fin. La déclaration de protection des données (DPD) de Creditreform s'applique à cet égard.
